Tariff and Customs Update: U.S. Customs and Border Protection (CBP) has confirmed the rollout of the CAPE (Claims and Processing Enforcement) system following recent proceedings at the U.S. Court of International Trade.
Key updates:
  • CAPE is live April 20 (Phase 1 rollout): Importers can now submit claims through the ACE portal for eligible entries.
  • Defined eligibility scope: Phase 1 includes unliquidated entries and those within 80–90 days post-liquidation.
  • System capabilities now active: The Claims Portal, Mass Processing Unit, Review & Liquidation/Reliquidation, and refund processing modules are operational.
  • Processing timeline established: Most validated claims are expected to be processed within 45–90 days depending on complexity.
  • Exclusions confirmed: Entries involving reconciliation, drawback claims, protests, non-ACE filings, missing liquidation status, or AD/CVD duties are not included in Phase 1.
CBP has also issued CSMS #68315804, offering guidance on ACE portal access, ACH refund enrollment, and key FAQs for importers transitioning to CAPE. The notice includes helpful links to walk users through setup and onboarding.
